Marco legal en el Perú a disposición en el CIISB:
1.-Política Nacional del Ambiente: Aprobada el 23 de Mayo de 2009, según Decreto Supremo N° 012-2009-MINAM. En su Eje de política N°1 sobre el uso responsable de la biotecnología moderna, plantea los lineamientos de política de bioseguridad. Lineamiento c de la Política Nacional del Ambiente en materia de Recursos Genéticos.
2.- Ley Nº 27104: Ley de la prevención de los riesgos derivados del uso de la Biotecnología, publicada el 12 de mayo de 1999.
3.-Decreto Supremo N°0108-2002-PCM. Reglamento de la Ley de la Prevención de los riesgos derivados del uso de la Biotecnología. Publicado el 28 de octubre del 2002
4.-Decreto Supremo N°003-2011-AG. Reglamento sectorial sobre seguridad de la biotecnología en el desarrollo de actividades con Organismos Vivos Modificados agropecuarios o forestales  y/o sus productos derivados, publicado el 15 de Abril de 2011.
5.- Decreto Supremo N°034-2011-PCM, publicado el 15 de Abril de 2011 y que modifica la conformación del Grupo Técnico Sectorial -GTS para el Órgano Sectorial Competente (OSC) del Sector Agricultura, incorporando al Ministerio del Ambiente, en reemplazo del Instituto de Investigaciones de la Amazonía Peruana (IIAP) al GTS del sector agricultura.
6.- Ley  N°29571 Ley de Protección y Defensa del Consumidor. Que necesita ser reglamentada y mediante la cual se exige el etiquetado de los OVM y productos que los contengan.

La Ley N°27104, en su Artículo 4 menciona las actividades que excluye la norma: "quedan excluidas de la presente ley, las actividades en genoma humano, a todo tipo de vacunas aplicadas a seres humanos". Como puede verse, la norma no excluye a los OVM que son utilizados como productos farmacéuticos humanos, excluye tan solo a las vacunas humanas que contengan o sean OVM. Por lo tanto, estos estarían siendo contemplados dentro del ámbito de la misma, con las exigencias que emanarían de su implementación.

Aun no se cuenta con la interpretación legal completa de este artículo.

La Ley N°27104 no prevee exonerar del Acuerdo Fundamentado Previo (AFP) a los OVM en transito y uso confinado; por lo tanto, estas actividades deberán seguir los procedimientos administrativos indicados en la normatividad nacional.

Cabe indicar sin embargo que los OSC no han culminado su reglamento y directrices técnicas internas que implementará este tema.

La Ley N°27104 y su Reglamento (D.S. N°108-2002-PCM) no estipula trato diferencial para el primer y subsiguientes movimientos transfronterizos de OVM.

Si bien el país dispone de una Ley desde el año 1999, los reglamentos sectoriales (de los OSC) no se han terminado de implementar. A la fecha  solo el Sector Agricultura ha aprobado su normativa sectorial el D.S. N°003-2011-AG, estando pendiente la aprobación de directrices técnicas y el reglamento del Grupo Técnico Sectorial, para terminar de implementar la normatividad en este sector.

Oficialmente nos se conoce de ningun caso de solicitud para aprobar liberaciones al ambiente de OVM.

La Ley N°27104, ni sus reglamentos establecen exoneraciones o procedimientos simplificados  para los OVM - AHAP. Asimismo no se establece que estos vayan a ser sometidos a evaluaciones sólo en el primer movimiento transfronterizo.  A la fecha los embarques  de OVM-AHAP (granos  de maíz, soya u otros) no indican si contienen o no OVM, ya que no se han establecido las especificaciones en los documentos de embarque o en el etiquetado.

Al momento, el OSC encargado de temas agropecuarios y forestales ha informado oficialmente sobre una aprobación de solicitud de OVM con fines de investigación y en contenimiento, referida a una genoteca BAC - papa, hecha por una universidad privada del Perú. No se ha puesto a disposición del CIISB el documento de amálisis y gestión de riesgo, así como la resolución respectiva. Cabe indicar asimismo que dicha aprobación se ha realizado en ausencia de una norma o directriz técnica aprobada a nivel nacional para usos de OVM en conteminiento como lo exige el Protocolo.

En el país no se han desarrollado estrategias de gestión de riesgos, ni se ha aplicado el artículo 16 a falta de decisiones. Sin embargo, desde el año 2008 se ha venido ejecutando el proyecto LAC Biosafety con la prticipación de Brasil, Colombia, Costa Rica y Perú. En este proyecto se vienen llevando a cabo actividades de investigación referidas al análisis y gestión de riesgos teniendo como modelos maíz, algodón y papa, y se espera que como resultado del proyecto emanen conocimintos de aplicabilidad en la realidad de los países participantes.

Desde el año 2008 a la fecha el Punto Focal Nacional ha designado fondos de recursos para el fortalecimiento de la institución y el fortalecimiento de capacidades. Paralelamente a los fondos del presupuesto público para sus labores, el Ministerio del Ambiente ha obtenido fondos adicionales, así el FMAM, financia con $20,000 la elaboración del segundo informe nacional sobre la implementación del Protocolo de Cartagena.
A través del United Nations Office for Project Services (UNOPS) como agencia implementadora, el FMAM financiará un proyecto denominado "Fortalecimiento de los Marcos Nacionales Estructurales de Bioseguridad- Segunda fase" proyecto que se llevará a cabo en cuatro años y por un monto de $811,000. Se prevé que dicho proyecto se inicie antes de terminar el año 2011.

El OSC del sector agropecuario y forestal designa dentro de su presupuesto de recursos ordinarios para la creación de capacidades, al igual que invesión pública directa para el fortalecimiento de infraestructura para bioseguridad. Asímismo, se han destinado fondos de inversión del tesoro público por seis millones de soles, de los cuales 8% corresponde a bioseguridad, para el establecimiento de un centro nacional de biotecnología agropecuaria y forestal, con una duración de 5 años.

Se espera mayor información del Sector.

El OSC del Sector Pesquero destina un presupuesto reducido dentro de los recursos ordinarios institucionales, los cuales son destinados básicamente para talleres de discusión del reglamento interno sectorial.

El OSC del Sector Salud, al momento, no cuenta con recursos de su presupuesto destinados a la creción  de capacidades en bioseguridad.

El INS ha iniciado una colaboración con FIOCRUZ de Brasil para capacitar a 33 profesionales en biosguridad, siendo parte del contenido de la capacitación, la bioseguridad relativa a los OVM.

La concienciación y participación pública trabajada en los ultimos años en el Perú, ha sido referida al conocimiento del Protocolo, la legislación nacional y temática de la bioseguridad.
