Le Sénégal a adopté la loi 2009 - 27 portant sur la biosécurité. Cette loi consacre en son article 5 la création d'une Autorité Nationale de Biosécurité (ANB) et d'un Comité National de Biosécurité (CNB).  Par la suite, le Chef de l'Etat a pris deux décrets portant l'un sur les missions, l'organisation et le fonctionnement de l'Autorité Nationale de Biosécurité (ANB) et l'autre sur les missions, l'organisation et le fonctionnement du Comité National de Biosécurité. L'ANB est une structure administrative composée de représentants des différents ministères concernés par la problématique de la biosécurité. Elle est chargée de faire des propositions en matière de décision sur la base du rapport scientifique d'évaluation des risques élaboré par le Comité National de Biosécurité.  Ce Comité qui regroupe entre autres quinze personnalités scientifiques choisies en raison de leurs  compétences est chargé de l'évaluation des risques liés à tout orgnaisme vivant modifié ou produit dérivé pour lequel une demande d'autorisation d'activité est soumise au Ministre en charge de l'environnement.

L'article 2 de la loi 2009 - 27 sur la biosécurité dispose : " La présente loi s’applique au développement, à l’utilisation, à l’utilisation en milieu confiné, à la dissémination dans l’environnement, à l’importation, à l’exportation, au transit, au transport et à la mise sur le marché d’organismes génétiquement modifiés ou de produits dérivés. Sont exclus de ce champ d’application, les organismes génétiquement modifiés ou produits dérivés qui sont des produits pharmaceutiques ou vétérinaires relevant d’autres accords ou organismes internationaux."

L'article 14 de la loi n° 2009 - 27 portant sur la biosécurité dispose: "Sur la base de&nbsp; nouvelles informations scientifiques sur les effets défavorables potentiels sur la conservation et l’utilisation durable de la diversité biologique, de la santé humaine et animale, le Ministre en charge de l’environnement peut, sur proposition de l’ANB, à tout moment, reconsidérer et modifier sa décision concernant une demande d’autorisation d’activités liées aux organismes génétiquement modifiés ou produits dérivés. <br /><br />Dans de telles circonstances, le Ministre en charge de l’environnement peut, sur proposition de l’ANB, aux frais du titulaire de l’autorisation ou des détenteurs des organismes génétiquement modifiés ou produits dérivés :<br /><br />- suspendre l’autorisation dans l’attente d’informations complémentaires et, s’il y a lieu, ordonner le retrait des produits de la vente et en interdire l’utilisation;<br />- imposer des modifications aux conditions de dissémination volontaire ;<br /><br />- ordonner la destruction&nbsp; des organismes génétiquement modifiés ou produits dérivés et, en cas de carence du titulaire de l’autorisation ou du détenteur y faire procéder d’office. <br /><br />Sauf en cas d’urgence, ces mesures ne peuvent intervenir que si le titulaire a été mis à même de présenter ses observations. <br /><br />Si les mesures prévues ci-dessus ne permettent pas de supprimer ou minimiser les risques, l’Autorité nationale compétente procède au retrait de l’autorisation. "

Au Sénégal, il est difficile d'affirmer aujourdhui que les capacités d'évaluation des risques liées aux OGM sont acquises ou disponibles. Cependant, certains acteurs parmi lesquels des scientifiques ont pris part à des ateliers de formation ou de renforcement de capacités en évaluation des risques organisés par le CILSS, l'Initiative du NEPAD sur la biotechnologie et la biosécurité, etc. Par ailleurs, dans le cadre de l'appui que le Programme Régional de Biosécurité de l'UEMOA apporte aux Etats membres, il est prévu deux ateliers de formation des membres du Comité National de Biosécurité en évaluation et gestion des risques liés aux Organimses Génétiquement Modifiés.
