In the framework of the UNEP/GEF Project implementation "Development of the Biosafety Framework in the Kyrgyz Republic" in 2005, National Survey on biosafety and draft law of the Kyrgyz Republic on biosafety have been elaborated, agreed Clearing House Mechanism, which was subsequently approved by the Government in 2006 and submitted to the Parliament in 2008 for consideration. This draft law was returned to the Government of the KR for reconsideration. From 2009 to 2010 this draft law have been reconsidered by the State Agency on Environmental Protection and Forestry under the Government of the Kyrgyz Republic together with experts and sent for concordance to the Government. Due to political situation (force majeure) in 2010, consideration of the draft law "On Biological Safety" have been postponed for uncertain period.<br />The main state authority competent for the fulfillment of Kyrgyz Republic obligations under the Convention on Biological Diversity and Cartagena Protocol on Biosafety is State Agency on Environment and Forestry under the Government of the Kyrgyz Republic.<br />At present the matter on changes in the organizational setting of the Government of the Kyrgyz Republic after Presidential Elections is under discussion (October 30, 2011).

According with the laws of the Kyrgyz Republic and international agreements, goods imported to Kyrgyz Republic have to comply with technical, phamacological, sanitary, veterinary, phyto-sanitary and ecological standards and requirements. Control over the quality and safety of pharmaceuticals is carried out by the Department on Sanitary and Epidemiological Control of the Ministry of Health of the Kyrgyz Republic&nbsp; &nbsp;

Draft law on biosafety have been elaborated in the part related to the implementation of the Article 7-10 of Cartagena Protocol where the regulatory norms are provided for, on prior informed consent and intentional introduction of LMO's into the environment, in accordance with the requirements of Cartagena Protocol.&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp;

Draft law on biosafety of the Kyrgyz Republic have been elaborated in the part related to the implementation of the Article 11 of Cartagena Protocol where the regulatory norms are provided for, on prior informed consent and intentional introduction of LMO's into the environment, in accordance with the requirements of Cartagena Protocol. In order to strengthen biosafety framework and coordinated development of local areas of scientific researches, the Government Resolution (1994) the Statutes of the International Center of Genetic Engineering and Biotechnology have been adopted. On the biotecnology issues there researches are carried out by the National Academy of Sciences and Center on Innovation Technology of the Kyrgyz Agrarian University, Research and Development Institute on Molecular Biology and Medicine under the National Center of Cardiology and Therapy of the Ministry of Health. In the Institute there is a modern equipment for various spectrum of molecular and genetic researches. Department on State Sanitary and Epidemiological Control of the Ministry of Health carries out virusology, sanitary-virusology, serological researches. It is planned to start researches of biologal food nutrients that contains components derived from genetically modified sources.

Arrangements aimed at precautionary protection, order the terms and conditions of determination of the risk level will be provided for by Regulations on Biosafety Regime approved by the Government of the Kyrgyz Republic (Article 4, paragraph 4.2)&nbsp; &nbsp; &nbsp; &nbsp; &nbsp;

In the elaborated Draft law on biosafety, in the part related to the implementation of the Article 16 of Cartagena Protocol where the regulatory norms on risks are provided for in accordance with the requirements of Cartagena Protocol.&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp;

In the prepared Draft law on biosafety in the part related to the implementation of the Article 17 of Cartagena Protocol, regulatory norms for unintentional transboundary movement and emergency measures&nbsp; are provided in accordance with the requirements of Cartagena Protocol.&nbsp; &nbsp;

In the prepared Draft law on biosafety in the part related to the implementation of the Article 18 of Cartagena Protocol, regulatory norms are provided in accordance with the requirements of CartagenaProtocol.

In the prepared Draft law on biosafety in the part related to the implementation of the Article 19 of Cartagena Protocol, regulatory norms are provided in accordance with the requirements of Cartagena Protocol. <br />In accordance with Government order No13 of 16.012006. The State Agency on Environment and Forestry under the Government of the Kyrgyz Republic is the competent state authority on implementation of obligation under Cartagena Protocol as well as National Coordination Body on BCH. In 2010 by the Government order the Center on Ecological Security have been established under the&nbsp; State Agency, which is includes matters related to provision of biological safety.&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp; <br />

Draft law of the Kyrgyz Republic on Biosafety is under consideration and adoption by the Government of the Kyrgyz Republic, and also, elaboration of the mechanism aimed at capacity building the National Coordination Center on BCH and Coordination Center on Cartagena Protocol. There is an ongoing work conducted on establishment of national competent bodies on biosafety and coordination of the their activity on submission of the information to BCH. In the framework of the BCH-1 project, working group have been created from the experts from all relevant ministries and agencies of the Kyrgyz Republic

In the prepared Draft law on biosafety in the part related to the implementation of the Article 21 of Cartagena Protocol, regulatory norms for information confidentiality are provided in accordance with the requirements of Cartagena Protocol.&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp;

Kyrgyzstan has access to the GEF Fund in the framework of the UNEP/GEF project "Development of the national framework on biosafety in the KR (2005)" implementation. National survey of the KR on biological safety have been elaborated and the draft law on "Biosafety". Kyrgyzstan participated in BCH-1 project in order to continue activities and expressed interest to participate in BCH-2.<br />At present project proposal have been developed to UNEP/GEF "Capacity Building for the Cartagena Protocol implementation by the Kyrgyz Republic", which is provides for implementation of the main matters related to biosafety on the territory of the country, including: creation of the institutional capacity and promotion of the national regulatory base on LMO's turnover with development of institutional regulations, rules, terms and conditions on execution of expert assessments of risks and capacity building of the laboratory base on LMO's identification.It is essential for get support of our initiative as the Center of Origin for Cultivated Plants <br />Kyrgyz Republic is interested in determination of the following key aspects that requires adoption of necessary measures on creation of biosafety system capacity building: assessment of the capacity, identification of opportunities, that are available on the national level, creation and strengthening of national institutions, development of human resources capacity building via education and professional training, creation necessary scientific institutions and centers for information management, assessment of the economical efficiency and security during technology transfer.

Obligatory point for the requirements implementation under the Cartagena Protocol for Kyrgyz Republic is development and implementaiton of measures aimed at public awareness rising on biosafety issues. Under this terms it is planned to use the following mechanisms: mass media, creation of consultation committee whcih would include representatives of all stakeholders, organization of workshops, round tables and conferences, work with target groups, working meetings, publications, public hearings, demonstrations and exhibitions, education and etc. Under the State Agency there is a Public Observary Board which is comprises representatives of NGO's, science, business and etc. In the meetings, matters are considered on regular basis related to international environmenmtal convention implementation which Kyrgyz Republic is a party, <br />In the trainings and workshops conducted in the framework of the BCH-1 project, representatives of NGO's and private sector participated. At present it is planned to conduct national workshop on the matters related to implementation of Cartageca Protocol (November, 2011.

Matters related to the ratification of the Kyrgyz Republic of Nagoya-Kuala-Lumpur Supplementary Protocol on Liability and Redress is under the consideration together with relevant stakeholders - ministries and agencies of the Kyrgyz Republic

The main constraints in the implementation of obligations under Cartagena Protocol on the national level is related to the absence of the regulatory legal basis on biosafety matters, which is creates, in its turn, constraints to institutional development, expert capacity, awareness rising among general public and decision makers and lack of financial resources&nbsp;
