The Republic of Rwanda has established a comprehensive regulatory framework to oversee products derived from modern biotechnology. This framework is anchored by Law No. 025/2024 of 16/02/2024 Governing Biosafety, which serves as the primary legislation for the sector. To ensure effective implementation, the following subsidiary regulations have been enacted: Prime Minister’s Order No. 006/03 of 18/02/2025: This order established the National Biosafety Committee (NBC). The Committee is mandated to support the competent authority by reviewing applications and conducting technical assessments for activities involving Living Modified Organisms (LMOs). Ministerial Order No. 003/MoE/25 of 13/01/2025: This order specifies the administrative modalities and procedures required to apply for permits to engage in LMO-related activities. Additionally, relevant guidelines are being developed to further support implementation.

Rwanda applies both internal regulation and national legislation for authorizing the release of living modified organisms (LMOs) into the environment, whether for experimental purposes or for placing on the market for commercial purpose. This legislation aligns with the provisions of the Cartagena Protocol, establishing a national regulatory framework compatible with it, in accordance with Articles 8.1 and 9.3 of the Protocol. Law No. 025/2024 of 16/02/2024 governing biosafety and Ministerial Order No. 003/MoE/25 of 13/01/2025 on permit application oblige any potential exporter or importer to notify the National Competent Authority prior to export or import of any LMOs. Articles 13 to 19 of the Ministerial Order No. 003/MoE/25 of 13/01/2025 provide further clarification on the information and requirement for LMOs intended for import, export, domestic use and commercialization. These provisions include specific requirements for packaging and labelling. This information must be submitted by the exporter or importer to enable the competent authority to make an informed decision. These provisions serve as a regulatory mechanism aimed at ensuring the accuracy and reliability of the information included in notifications submitted by the applicant. These provisions form part of the national framework for ensuring biosafety in transboundary movements of LMOs. Decisions regarding the issuance of an Advance Informed Agreement (AIA) are made by the Competent National Authority, which is the state organ in charge of Environmental Management. These decisions are taken in consultation with the National Biosafety Committee (NBC) to ensure a scientifically sound and transparent decision-making process.

Further, the Ministerial order determines the food, feeds or their ingredients produced from living modified organisms where there is presence of genetically modified material in proportions of equal or more than 5% or above of total weight. Article 15 on traceability of food and feeds produced from LMOs of the above mentioned Ministerial Order indicate that A permit holder, every time he or she places on the market a product consisting of, or containing living modified organisms, ensures that the following information is transmitted in writing to the operator receiving the product, where applicable : (a) that it contains or consists of living modified organisms; (b) the unique identifier assigned to those living modified organisms.

Article 20 of the Ministerial order No. 003/MoE/25 of 13/01/2025 on the application for a permit for Living Modified Organisms related activities stipulate that an applicant for data transportability of the same living modified organisms may request to the Authority to consider data or results of a living modified organism similar to that for which he or she applies for a permit for intentional introduction into the environment or placing on the market provided that it was grown under similar environmental conditions for intentional introduction. In case data or results were recorded outside Rwanda, the applicant provides a written agreement with the source of data or results to the Authority.
