Competent authority responsible for contained use matters in the Brussels-Capital Region.
The contained use of living modified organisms (genetically modified organisms) is regulated in Belgium at the regional level. The Regions (through their Ministry for the Environment) are responsible for the follow-up of administrative procedures, for authorizations and for inspections. Decisions are taken on the basis of a scientific advice, which is given in a centralized way by the Biosafety and Biotechnology Unit (SBB) of the Scientific Institute of Public Health or, in specific cases, by the Biosafety Advisory Council.

All contained uses of pathogenic and/or genetically modified micro-organisms must be performed inside a relevant installation covered by an environmental permit.
The notification or authorisation procedure for such uses is established by the Decree of the Government of the Brussels-Capital Region of 8 November 2001 (Belgian Offical Journal 26.10.2002, p. 7209).
The request for a certificate or for an environmental permit for the above-mentioned installations shall contain a risk assessment of the contained use of GMOs and/or pathogenic organisms as regards risks for human health and the environment, and shall indicate the maximum level of containment that could be reached in the installation.
The advice of the Biosafety and Biotechnology Unit (SBB) is requested during the instruction of requests for certificates and for environmental permits.
The whole information that has to be given to ask for an authorisation or to notify a contained use activity represents the biosafety dossier. In order to facilitate the information and notification procedures and to limit the administrative constraints for the notifiers, the SBB has, in collaboration with the Regional competent authority, developed notification forms, a user guide and several risk assessment guidances, on the basis of the requirements of the regional Decree as well as on the experience gained with the implementation of this regulation.
