The Law on the Implementation of the Regulation on Transboundary Movements of Genetically Modified Organisms (Official Gazette No. 81/2013) establishes the competent national authorities responsible for the implementation of the Regulation (EC) no. 1946/2003 and stipulates their tasks.
Tasks of the competent national authority responsible for nature protection in the Ministry of economy and sustainable development has been stipulated in accordance with articles 4, 5, 9 para. 1, 14, 15, 17 and 19 of the Regulation (EC) no. 1946/2003. The Ministry performs duties of National Focal Point for the Cartagena Protocol on Biosafety as well as the BCH National Focal Point. The Customs Administration carries out customs supervision over the cross-border transfer of GMOs.
The Regulation itself (Reg. (EC) no. 1946/2003) governs the procedure with regard to transboundary movements of GMOs that may have adverse effects on the conservation and sustainable use of biological diversity, taking also into account potential risks to human health and in accordance with the precautionary principle stipulated by the Cartagena Protocol on Biosafety to the Convention on Biological Diversity. It laid down the system of notifications, and exchange of information on transboundary movements through the Biosafety Clearing-House. Provisions of the Regulation apply to the GMOs intended for deliberate release into the environment,GMOs intended for direct use as food or feed or for processing (LMO-FFPs) and GMOs intended for contained use. Provisions also cover transits of GMOs as well as unintentional transboundary movements of GMOs.
